S/PLUS TERMS & CONDITIONS
INTRODUCTION
The S/PLUS loyalty program is offered in Australia by Amer Sports Australia Pty Ltd (ACN 063 414 568) (hereinafter referred to as "SALOMON" or "we" depending on the context). CLAUSE 1 - ELIGIBILITY
To participate in the Program, you must be at least 16 years old and a legal resident in Australia or New Zealand. If you are at least 16 years old but under the age of 18 (or the legal age in your jurisdiction of residence), you will also need to have permission from one of your parents or guardians before joining the Program, and your parent or guardian must have read and agreed to these Terms and Conditions.
The S/PLUS loyalty program (hereinafter the "Program") is offered to all individual customers, adult natural persons, holders of an email address, hereinafter referred to as the "Account Holder", "Customer" or āyou.ā
The Program is not accessible to legal entities (companies, associations, etc.).
By joining and participating in the Program, you confirm that you meet these eligibility requirements.
CLAUSE 2 - JOINING THE PROGRAM
If you meet the eligibility conditions, you can join the Program by completing a registration form on https://salomon.com.au/pages/s-plus .
Each natural person may only have one account. If you join the Program, you agree to provide true, accurate, current and complete information about yourself and to keep it up to date. Any incomplete request will not be considered by SALOMON.
Membership of the Program is not subject to the obligation to purchase a product.
SALOMON reserves the right to request any document at any time in order to verify the identity of the person wishing to subscribe or who has subscribed to the loyalty program.
CLAUSE 3 - MEMBER COMMUNICATIONS
By joining the Program, you may receive electronic service communications from SALOMON relating to the loyalty program including to inform you of your member benefits as well as marketing emails.
CLAUSE 4 - MEMBER BENEFITS
Your experience with the SALOMON brandāin particular through your purchases, your participation in events and your subscription to the newsletterāwill result in advantages for you if you register for the Program.
Here are some the benefits of being a member of the Program:
- Free standard delivery for eCommerce orders.
- Early access to certain sales: (the duration of advance access may vary sale to sale and our standard terms and conditions of sale will apply to any purchases).
- Access to events organised by SALOMON, subject to registration and available places.
- Potential access to exclusive offers based on your experience with the SALOMON brand, in particular through your purchases, your participation in events and your subscription to the newsletter.
- Free returns for products, other than winter sports products (skis, snowboards, boots, bindings, poles, helmets, goggles), in circumstances which comply with our returns policy https://salomon.com.au/pages/returns-2
CLAUSE 5 - ACCOUNT USE
The use of your account is strictly personal and non-transferable. You are solely responsible for any use that may be made of your login details, and you agree not to disclose them to anyone.
It will be your responsibility to maintain the confidentiality of your account, and you are fully responsible for all activities carried out using your password or your account. You must promptly notify the SALOMON customer service team of any unauthorised use of your password or account, or any other security breach.
CLAUSE 6 - SALOMONāS COMMITMENT
SALOMON undertakes to use its reasonable endeavours to implement the Program according to its terms and provide benefits to Members. However, SALOMON cannot be held liable for damages of any kind related to the Program, including delays, delivery errors, connection problems, loss of data or other anomalies. SALOMON cannot be held liable in the event of an event relating to force majeure as defined by law and case law.

CANCELATION

CLAUSE 8 ā MODIFICATIONS TO OR CESSATION OF THE PROGRAM
SALOMON reserves the right, at any time, to modify, suspend or cease the Program without having to justify its decision and without any compensation with regard to Members. Of course, advantages such as free standard delivery will apply to orders in place at the time of modification or cessation.
SALOMON reserves the right to modify at any time all or part of these General Conditions, including the terms and conditions for acquiring loyalty benefits.
We may cancel your membership in the Program at any time or suspend it if we determine that (a) you are not eligible for it within the confines of clause 1 above; (b) you have violated any of the provisions of these terms and conditions; or, that (c) you have committed any deception, tampering or fraud, or any other abuse of the Program.
We reserve the right to cancel all or part of your benefits if we believe that you have received benefits in error or through fraud or deception, or in any unauthorised manner.
In the event of cancellation of your membership in the Program, the provisions of our privacy policy apply to the data provided during registration.
CLAUSE 9 - PERSONAL DATA
Personal data transmitted as part of the Program is recorded and processed in accordance with the terms of our privacy policy available at https://www.amersports.com/privacy-policy/.
CLAUSE 10 - GENERAL PROVISIONS
If any of the provisions of these general conditions are declared invalid, illegal or inapplicable, this stipulation would be applied within the strict limits of what is permitted by the applicable legislation. The other stipulations would remain valid and fully applicable.
